Korea issues antitrust guidelines for patent owners

Korea’s antitrust watchdog has issued new guidelines for IP owners that explain how they can set industry standards without breaching the country’s competition law.

The guidelines deal with potential infringements, including price fixing, limiting competition by restricting who can take part in the standard-setting process, and ways of using the adopted standard.

Yulchon law firm says that although the guidelines are only advisory, the Korean Fair Trade Commission plans to monitor closely and regulate abuse of IP rights. It recommends that businesses in the high-tech sector evaluate their practices in the light of the guidelines to ensure that they do not breach the rules.
