Optus wins TV copyright battle

The Federal Court’s controversial decision in favour of Optus has created uncertainty over the future of mobile rights in Australia

Justice Steven Rares found yesterday that telecoms provider Optus did not infringe copyright laws by showing sports online with its new TV recording app TV Now.

“It is a surprising judgment,” said Michael Williams, partner at Gilbert + Tobin. “It gives a completely unique interpretation of the right of communication.”

Optus’s TV Now service, introduced in July 2011, allows users to record free-to-air televised games and play them back on compatible devices – computers, 3G phones, and Apple and Android products – with a delay of about two minutes.
