Lawyers welcome patent-specialist court

Litigators in Switzerland say the country’s new Federal Patent Court should make cases quicker and decisions more consistent

The new Court came into operation on January 1 this year. It will hear all disputes relating to the validity and infringements of patents and supplementary protection certificates.

Disputes over other IP rights will still be heard in the cantonal courts. In cases that involve patent rights, such as ownership and licensing disputes, parties can request a transfer to the new court.

The Federal Patent Court is headed by president Dieter Brändle, who was formerly a senior judge specialising in patents in Zurich. He is joined by one other judge, plus a roster of 36 part-time judges who are lawyers and...
