Brand owners seek criminal penalties in Asia

How to measure the success of investigations was the hot topic among panellists at the Asia-Pacific IP Forum in typhoon-hit Hong Kong this week

"To assess success, one tool that has been used on the criminal enforcement side is that if we perform one raid, one person should go to jail. Ideally, the ratio should be 1 to 1," said Mayank Vaid, Asia-Pacific IP enforcement director at LVMH.

"On the civil side, [success is measured] by a value or ratio on how much money can be recovered. This can range from jurisdiction to jurisdiction by about 30% to 60%," he added.
