Copying work onto a server and uploading it is deemed “communication to the public" in a decision that also distinguishes between hyperlinking and posting online under copyright law

While clearly distinguishing between hyperlinking to and posting content online in copyright law, the Court of the EU ruled yesterday that copying work onto a server and uploading it is “communication to the public” under the Copyright Directive.
