As business becomes an increasingly global affair, Latin America represents an ever more important region for companies seeking to penetrate new markets and protect their intellectual property rights. However, most Latin American nations still have a long way to go when it comes to enforcing such rights. Managing IP, together with Olivares & Cia, Baker & McKenzie Latin America and Obligado & Cia considered the situation, with additional insights provided by representatives from BatMark Limited and the US government. The participants discussed a range of issues from the most effective ways to fight counterfeiting in the region to consumer awareness of fakes and the role of free trade agreements in IP regimes in Latin America.

EM: How big is the counterfeiting/piracy problem in Latin America today?

AC: Counterfeiting and piracy represent serious problems for all Latin American countries. Countries such as Panama and Paraguay act as hubs for the transport of counterfeit merchandise into other countries. Their geographic location and their free trade zones enable the transit of counterfeit merchandise, especially from China. For other countries, such as Brazil, the existence of counterfeit and pirated products negatively impacts foreign investment and contributes to tax evasion.
