Polish publisher Technopol has lost out in its attempt to have the number 1001 trade marked in Poland for directories and similar publications.
The Supreme Administrative Court dismissed Technopol's appeal saying the number lacked primary distinctiveness, and was too similar to names of similar products to acquire distinctiveness.
The ruling follows the Court of Justice of the EU's ruling last month that the number 1000 - also applied for my Technopol and appealed all the way to the CJ - was not distinctive for similar reasons. The Court did say, however, that some number marks could be registered. See Managing IP story here.
