The innovation patent has immense practical and commercial value; it is not only an enforceable intellectual property right per se, of potential value to any IP portfolio and a warning to competitors, but also an extremely useful litigation tool that can quickly target specific infringing conduct. For this reason, applications for innovation patents in Australia are commonly being made for strategic and tactical reasons. This is not in line with second-tier patent systems around the world and for this reason innovation patents are a breed of intellectual property which is unique to Australia....
