He has extensive experience in patent drafting, filing and prosecution before the European Patent Office and other jurisdictions, as well as in securing registered design protection and advising on design-related matters. He routinely provides strategic advice on freedom to operate and enforcement issues.
Toby is particularly recognised for his expertise in restoring lost rights, including the re-establishment of lapsed patents, restoration of priority claims, and entry into the European phase after missed deadlines. His knowledge in this area has also contributed to the development and ongoing improvement of the firm’s internal systems and procedures.
Known for his inventive mindset, Toby brings creativity to his client work, whether drafting complex patent applications, formulating arguments for inventive step or supporting restoration cases with due care evidence.
