Young Conaway offers a broad range of intellectual property services to national and international corporate clients. We are focused on achieving our clients’ specific business objectives. With many years of experience in both jury and bench trials before Delaware’s federal and state courts, our attorneys are often asked to take a lead role in technical, bet-the-company cases. The Intellectual Property Litigation Section continues to grow and has been actively adding associates.

Filings in Delaware

The United States District Court for the District of Delaware and the State of Delaware’s Court of Chancery continue to see an increase in intellectual property filings because of the courts’ ability to handle complex, accelerated matters. Several Young Conaway attorneys have served as law clerks or interns and have gained an in-depth knowledge of the state and federal judiciary. With meticulous attention to detail and big picture strategic vision, our attorneys have developed tactics that permit them to efficiently and effectively represent clients across a diverse range of industries and technologies.

Experienced Litigators From Start To Finish

Young Conaway’s litigators can handle every stage of the litigation, from Markman hearings to motions for summary judgment, trials and appeals. Several of Young Conaway’s attorneys also have experience before the USPTO in both traditional ex parte and adversarial proceedings. If it is not in our client’s best interest to litigate a matter, the firm has attorneys who are experienced in handling intellectual property disputes through alternative dispute resolution venues.

Trademarks

Clients and companies turn to Young Conaway and its team of attorneys to evaluate proposed trademarks and engage in enforcement proceedings on behalf of the firm’s clients.

Thought Leaders

Members of Young Conaway’s Intellectual Property team are active as officers and leaders in intellectual property focused bar organizations and are asked to speak at many national and international seminars. They have been recognized by clients and colleagues as leaders in their field by Corp INTL, IAM Patent 1000, Chambers USA – America’s Leading Lawyers for Business, Best Lawyers®, Benchmark Litigation: The Definitive Guide to America’s Leading Firms and Attorneys, and Delaware Super Lawyers®.

Barnes & Thornburg’s Intellectual Property practice is among the largest in the country, with nearly 130 IP attorneys and professionals and 75 registered patent attorneys and agents. Our clients know that their intellectual property — inventions, brands and trade secrets — are as valuable as their factories, laboratories and inventories. We believe that intellectual property must be cultivated and nourished to grow as an asset and without the right care, it will wither.

Our team works diligently to help clients succeed in overseeing and protecting their valuable IP with employees, customers, partners and competitors, and to avoid infringement of the IP rights of others. We position and leverage our client’s critical IP in industry and specialized markets, and defend patent, trademark and copyright integrity in the judicial system and in agency review and appeals.

We assist product development, marketing, sales and finance teams with comprehensive IP programs and protect products from copying by competitors. We advise on IP holdings valued into the billions of dollars of market share, representing Fortune 500 companies with thousands of IP assets, as well as startup companies defined by a single patent. Our attorneys are committed to client service, cohesive teamwork, responsiveness and useful advice.

From coast to coast, we counsel clients from a variety of industries, such as medical device, plastics and packaging, internet and computer technology, food and beverage, pharmaceutical, automotive and aviation. With decades of experience, we understand that the many types of IP assets drive core business strategy and brand development. Our cost-conscious solutions help clients derive as much value from their intellectual resources as from their human resources.
