Deutsche Bahn loses red/grey appeal

The EU General Court has rejected Deutsche Bahn's appeal of OHIM's refusal to register the colour combination of red and grey for its train services.

The Court agreed with the examiner that the colours lacked distinctiveness as they both commonly occur in rail services.

They cannot therefore indicate the origin of the services, it said.
