It has been 12 years since the last amendment to China's Patent Law. The fourth amendment to the Patent Law comes into force on June 1 2021 and will strengthen the country's patent environment.

Changes introduced include alterations to patent filing, enforcement, protection, rights and the design patent system – all of which are covered in-depth by our IP experts. The guide also provides interesting insights on standard essential patent cases, licensing, and the record filing system in China.

In addition to the evolution of the world of patents, there have been changes to the Copyright Law – and key practical differences and implications that will arise from the third amendment are discussed in great depth.

Other important issues discussed include the significance of the Anti-Unfair Competition Law on the Chinese IP world, the importance of registering Chinese language marks, and algorithmic solutions under the amended Patent Examination Guidelines.

Finally, IP experts provide a real insight into the obstacles to overcome when establishing a successful trademark environment and the techniques that legal teams can take during the evidence collection stages of IP disputes.

We hope you enjoy hearing from the IP experts on a wide range of topics in the 2021 China IP Focus.
