Managing IP has two timely webinars coming up in November – one on Defend Trade Secrets Act cases, the other on enhanced damages under Halo

Managing IP is hosting webinars in November focused on two topics that have become big issues in the US this year.

The first webinar is Update on the Defend Trade Secrets Act: Recent Cases and Emerging Issues, taking place this Thursday November 3 at 12 noon Eastern Time. This will be presented by R Mark Halligan of FisherBroyles, Mark L Krotoski of Morgan Lewis & Bockius, Linda K Stevens of Schiff Hardin and Peter J Toren of Weisbrod, Matteis & Copley. 

The Defend Trade Secrets Act of 2016, signed into law in May, provides the first federal civil cause of action for trade secrets misappropriation. This webinar will discuss the cases filed under the new statute and explore the emerging legal and strategic issues facing DTSA litigants. This is a follow-up to a webinar we held in September that discussed strategies for understanding and litigating a DTSA cause of action. The second webinar is Halo – How is the judicial discretion approach to enhanced damages being applied?, taking place on Wednesday November 16 at 12 noon Eastern Time. This will be presented by Michael McGraw, partner at Fitzpatrick, and Lisa Butler, associate at Fitzpatrick.

In June the Supreme Court decided that the two-part Seagate test being used to decide whether or not an infringer is subject to enhanced damages was inconsistent with the statutory authority (35 U.S.C. §284) relied on for those claims. The webinar will discuss Halo and the impact it has had on claims made under §284 in the district courts since June.
