The impact of the Supreme Court’s Alice v CLS decision is already being felt in both patent litigation and prosecution
On July 11, the Federal Circuit released its first opinion that cited Alice, when affirming that claims in Digitech’s US patent 6,128,415 are not patentable under 35 USC § 101 in Digitech Image v Electronics for Imaging.
