i4i prevails over Microsoft in Supreme Court

The Supreme Court today affirmed the Court of Appeals for the Federal Circuit’s decision in Microsoft v i4i, upholding the clear and convincing standard of proof in asserting patent invalidity
The justices reached a unanimous decision, with Chief Justice John Roberts taking no part.
Justice Stephen Breyer wrote a concurring opinion, joined by Justices Samuel Alito and Antonin Scalia.
Justice Clarence Thomas also wrote a concurring opinion.
