GSK awarded Arrow declaration by UK High Court

Mr Justice Arnold shed some light on obviousness declaration criteria in the UK in his ruling that Vectura’s patents were not obvious but were insufficient

In a ruling that sheds light on the criteria for an obviousness declaration, the UK High Court has awarded Glaxo Smith Klein with an Arrow declaration after finding that the drug manufacturer had not infringed on another company’s patents.
