OHIM and TTAB address criticisms

The heads of OHIM and the US Trademark Trial and Appeal Board fielded some tough questions about their respective agencies’ methods during the Fordham IP Conference in New York
TTAB chief judge Gerard Rogers was asked by a fellow panellist, Craig Mende of Fross Zelnick Lehrman & Zissu, whether the Board has ever considered using sanctions to discourage entities from using the opposition process as a way to simply delay registration of a valid mark.
Because extensions of time are liberally granted in TTAB proceedings, Mende said his firm sees many cases in which opposing parties are simply trying to buy time.
