The introduction of the America Invents Act has revolutionised the patent litigation system and with over five years in practice, there is no doubt that the Patent Trial and Appeal Board has had a colossal impact on the global patent landscape. However, due to the current complex and unpredictable environment, patent owners need to ensure their portfolio is flexible and robust to manage any uncertainties which could arise from the Supreme Court review of constitutionality.
