Brussels I to be revised for UPC

The European Commission has proposed changes to the Brussels I Regulation in readiness for the introduction of the Unified Patent Court (UPC)

The Brussels I Regulation concerns the recognition of judgments. The changes required concern how its jurisdictional rules work for the UPC, parties to the UPC and other member states and are unlikely to be controversial.

The Commission said it is also encouraging EU member states to ratify the UPC Agreement as quickly as possible. Unitary patents can only be granted, and the Court come into operation, once the Agreement has been ratified by 13 countries, including France, Germany and the UK.

It is unlikely the Court will come into operation before 2015.
