Academics call for EU law to protect trade mark fair use

A group of senior trade mark academics has called on European law makers to specify how third parties can use trade marks without infringing them, saying that it is important to balance the rights of trade mark owners with freedom of expression and the guarantee of undistorted competition

In particular, they want the new European trade mark legal framework now being considered by the European Parliament and the Council to clarify that a range of trade-mark related activities fall into a free use category.
