EU trade mark offices set for shake up

National trade mark offices in Europe will have to abandon examination on relative grounds and introduce opposition and invalidation procedures, under changes to the EU Trade Marks Directive to be proposed by the European Commission

Draft reforms to the Directive have not yet been published, but have been seen by Managing IP.

They propose that the ex officio examination of trade mark applications is confined to absolute grounds. The Commission says that relative grounds examination...
