Google dealt another blow with Rosetta Stone ruling

A US appeals court has reversed much of a district court’s ruling in favour of Google in a case that will help to shape the law around the use of trade marks as keywords and in sponsored ads
The decision comes just days after the Second Circuit Court of Appeals rejected much of another lower court’s ruling in favour of Google/YouTube, sending Viacom’s $1 billion case against the search engine back to a lower court for further consideration.
In August last year, the US District Court for the Eastern District of Virginia granted Google’s counterclaim for summary judgment against Rosetta Stone, essentially dismissing all of Rosetta Stone’s claims that Google’s use of the language learning company’s trade marks in sponsored advertisements was infringing. ...
