Call for SPCs to be longer than five years

The five-year limit on supplementary protection certificates in the EU needs to be extended, said André Bourgouin of Ipsen Pharma last week
The EU introduced SPCs in 1992 to provide pharmaceutical inventions with an extended period of protection to compensate for the time it takes to obtain marketing approval. Under the present system the combined market exclusivity of a patent and SPC cannot generally exceed 15 years.
Speaking at a workshop at the AIPPI Congress in Paris, Bourgouin said that since 1992 "the requirements of registration agencies have considerably increased"...
