OHIM overhauls CTM classification rule following IP Translator case

A new practice will come into force tomorrow (June 21) under which Community trade mark applicants who use the general indications of a class heading must expressly indicate whether they intend to cover all goods and services in that class, or only some of them

OHIM today said that it has updated its practice following the Court of Justice of the EU decision yesterday in the IP Translator case.

According to a new Communication of the President, applicants can still use the general indications of the Nice class headings to identify the goods and services they want covered, provided they are sufficiently clear and precise.
