Apple, the iPad and assignee rights
A few simple steps could prevent you losing the rights to a valuable trade mark in China, say Zhu Zhigang and Paul Ranjard. They include a notarised contract, an exclusive licence and strategic discretion
After the iPod and the iPhone, Apple's iPad became an immediate and
worldwide success. But in China the company ran into a little problem:
the trade mark iPad had already been registered by a company called
Proview. Apple had to buy it from Proview before the new device could be
launched in China. In the process, something went wrong: Apple and
Proview ended into a fierce judicial battle....
