Kolon counterclaim against DuPont dismissed

A US court’s summary judgment for DuPont against Kolon could inspire more use of trade secrets at a time when US patent law is in transition

The ruling, delivered last week by the US District Court for the Eastern District of Virginia, dismissed Kolon Industries' counterclaim against DuPont, which alleged antitrust violations for monopolisation of the market for Kevlar and related products.

Last year, a jury delivered a $920 million verdict for DuPont, finding Kolon liable for misappropriating DuPont's trade secrets related to paramid fiber technology used in Kevlar products.

Kolon responded by filing a countersuit against DuPont for antitrust violations.

DuPont moved for summary judgment to dismiss the antitrust claims, and after several attempts to amend their counterclaim, Kolon appealed the ultimate dismissal of their suit to the Fourth Circuit Court of...
