USPTO proposes consolidated trial rules

The USPTO has proposed a consolidated set of rules for trial practice before the Patent Trial and Appeal Board, as part of the implementation of het America Invents Act.

The rules cover inter partes review, post-grant review, the transitional programme for covered business method patents and derivation proceedings.

The Office has also published a Trial Practice Guide, which advises on the general framework of the proposed regulations.

A 60-day public comment period on the rules and Guide starts today.
