Two FTAs between Latin American and Asian countries containing substantial IP provisions took effect this month.
The Costa Rica-China agreement contains provisions for genetic resources, traditional knowledge and folklore, and border measures.
The Peru-Korea FTA includes those provisions as well as copyright protection for literary or artistic works for 70 years after the author’s death.
“While they do not include standards as high as those imposed by EU or US in their FTAs, it is interesting to see that they do contain some substantial provisions, in particular the one between Peru and Korea,” said Aurelio Lopez-Tarruella Martinez of IP Tango.
