Defeats cast doubt on copyright troll model

In the last two weeks copyright holding company Righthaven has lost a series of cases that have cast doubt on the effectiveness of the litigation strategy of so-called copyright trolls

The latest decision came on Monday this week when US District Judge Philip Pro of the Nevada District Court stated that Righthaven “does not have standing to bring a suit for infringement”, and, even if it did, the defendant Wayne Hoehn would have won using the fair use defence, even though it had republished an entire article.

Righthaven is a copyright holding company based in Las Vegas that brought its first case on behalf of the Stephens Media-owned Las Vegas Review Journal in March last year. It has also been suing people on behalf of the Denver Post newspaper.
