Most lawyers are familiar with forum shopping: choosing the best venue to fight for their clients' rights. But, until recently, the majority of forum shoppers sought litigation bargains within their own country or region. US lawyers weighed up the advantages of filing a case in Texas or California; their counterparts in Europe compared the benefits they might achieve by having their disputes heard in Italy or Germany.

Now the globalisation of business and of patenting means that more disputes than ever before are being litigated across borders. That makes life far harder for lawyers....
