An article by Professor John Duffy on Patently O posits that it may be in the best interests of the Bilski petitioners - Bernard Bilski and Rand Warsaw - to seek dismissal of the case at this point.
Since neither Bilski/Warsaw nor their company, WeatherWise, own the patent at issue anymore, and since Bilski and Warsaw have other pending patents that would fare well under the machine-or-transformation test, Duffy is puzzled by the petitioners' persistence.
