Onel case to be decided on written submissions

The Court of Appeal in The Hague has asked the two parties in the Onel trade mark dispute to submit written observations over the next month

A hearing in the case, which addresses whether use of a Community trade mark in just one EU member state is enough to constitute genuine use, was due to take place today.

But Managing IP understands that the Court, with the consent of both parties, has changed the hearing into a written procedure.
