Pharma trade marks under threat in France

France’s Senate and National Assembly have approved a law that would allow generic companies to copy the shape and colour of branded pharmaceuticals, potentially overriding trade mark rights
The relevant provision is part of the Financing National Social Security 2010 law.
It was adopted by the Senate on November 15 and by the National Assembly on November 25.
The law proposes to amend the Public Health Code by introducing Article L 5121-10-3....
