ECJ addresses trade mark free riding in L’Oréal case

In an opinion that is likely to be welcomed by brand owners, the ECJ’s Advocate General today set out a two-step test for trade mark infringement cases involving alleged free riding

The opinion, which is not binding on the court, comes in a dispute between perfume maker L’Oréal and rival Bellure.
