Italian luxury goods maker Salvatore Ferragamo has won a key judgment from Korea’s Supreme Court, in the latest in a series of rulings in favour of trade mark owners
On October 9, the Court ruled that a design displayed on a shoe is an indication of source and can be trade mark infringement
Salvatore Ferragamo filed suit against Daeho Corporation, the producer of Pierre Cardin shoes in Korea, in 2005 and won in the Patent Court in June 2007. Daeho then appealed the case to the Supreme Court.
"The trend is that all kinds of designs, even if they are just a character or device, may be a trade mark if they indicate the source of the product," according to Dongoh Hong, an associate of Yoon Yang Kim Shin...
