Australian copyright case could go to highest court

Australia’s highest court is considering an application for leave to appeal made by a compiler of an electronic TV programme guide in a groundbreaking case dealing with copyright in compilations
IceTV handed in its final submissions to the High Court on July 2 and the Court is expected to decide in October whether or not to take the case.
In a decision made on June 24, Justice Annabelle Bennett of the Federal Court of Australia restrained IceTV from reproducing or making available to the public information from the Channel Nine weekly programme schedules.
The courts are continuing to demonstrate that they are prepared to afford copyright owners of factual compilations significant protection, Natalie Hickey, a partner of Mallesons Stephen Jaques in Melbourne told Managing IP.
