Luxembourg: The music industry suffered a blow on January 29 when the EU's top court ruled that member states are not required to oblige ISPs to provide personal data to IP owners to allow copyright owners to launch civil proceedings against alleged infringers. In its ruling, the ECJ concluded that the European directive on privacy and electronic communications does not stop member states from including in their own laws an obligation to disclose personal data in the context of civil proceedings. However, it went on to say that neither does the directive compel member states to lay down such an obligation.
