The Indian Patent Office has issued a draft manual of patent practice and procedure designed to clarify how examiners should assess patent applications.
The Office posted the manual online on February 25 and has given users of the system one month in which to provide feedback.
The draft manual offers some guidance as to how examiners should deal with applications that concern the controversial section 3(d) of Indias patent law.
Section 4.5.6 quotes the Madras High Court decision against Novartis made in August this year.
