H&M wins appeal in Russia

The Moscow Court of Cassation rejected the appeal of trade mark squatter Boris Kostyrin against his loss of the H&M trade mark on July 18.

The Moscow Arbitrazh Court ruled on February 6 that Boris Kostyrin, whose company – H&M International – had registered the mark in Russia, had no rights to the H&M trade mark.

The Court of Appeal has also turned Kostyrin down. It is still possible that he will appeal to the Supreme Arbitration Court, but Natalia Gulyaeva, a consultant with Lovells, which represents H&M, told MIP Week that the court is unlikely to accept the case.

H&M has repeatedly ignored Kostyrin’s offers for a cash settlement. Kostyrin refused to comment on the decision.
