Supreme Court backs Polo trade mark

The Japanese Supreme Court has demonstrated its willingness to give broader protection for famous marks like Polo. John Tessensohn and Shusaku Yamamoto examine the decision

In a positive development for owners of famous trade marks, the Supreme Court in PALM SPRINGS POLO CLUB, [Heisei 12 (gyo-hi) 172, July 6 2001], denied an attempt by Heaven Corporation, a Japanese firm, to register a trade mark bearing the Polo name, reversing an earlier Tokyo High Court ruling.
